These Terms and Conditions (hereinafter referred to as the "Terms") govern the use of the website rodnei-retreat.com (hereinafter referred to as the "Website") and the services provided by Rodnei Retreat & Spa (hereinafter referred to as the "Operator", "we", "us" or "our").
By accessing and using this Website, as well as by making a reservation or using our services, you confirm that you have read, understood and accepted these Terms in their entirety. If you do not agree with any provision of these Terms, please do not use the Website or our services.
These Terms are supplemented by the applicable Romanian legislation, including the Romanian Civil Code, Government Ordinance No. 21/1992 on consumer protection, Law No. 365/2002 on electronic commerce, and Government Emergency Ordinance No. 34/2014 on consumer rights.
By using the Website, you agree to use it exclusively for lawful purposes and in accordance with these Terms. The Website content is intended for informational purposes and to facilitate bookings for accommodation and services provided by Rodnei Retreat & Spa.

We make reasonable efforts to keep the Website continuously available. However, we do not guarantee that the Website will be available without interruption or errors. We reserve the right to suspend or discontinue the Website, temporarily or permanently, for maintenance, updates, or other justified reasons, without prior notice and without liability for any resulting damages.
The Operator shall not be liable for non-performance or improper performance of its contractual obligations where such failure is caused by a force majeure event, as defined by Article 1351 paragraph (2) of the Romanian Civil Code.
Force majeure events include, but are not limited to: natural disasters (earthquakes, floods, landslides, avalanches), fires, epidemics or pandemics, war, acts of terrorism, general strikes, decisions of public authorities, utility service interruptions (electricity, water, gas), and other similar events beyond the reasonable control of the Operator.
In such situations, the Operator will make reasonable efforts to inform guests and to offer alternative solutions or refunds, depending on the circumstances.
Rodnei Retreat & Spa respects and protects the confidentiality of your personal data in accordance with the General Data Protection Regulation (GDPR — EU Regulation 2016/679) and applicable national legislation.

By using the Website and our services, you confirm that you have read and understood the Privacy Policy. Personal data provided during the booking process will be processed exclusively for the purposes stated in the Privacy Policy.
In accordance with Government Emergency Ordinance No. 34/2014 on consumer rights, consumers generally benefit from a 14-day right of withdrawal for contracts concluded at a distance or away from business premises.
However, pursuant to Article 16(l) of GEO No. 34/2014, the right of withdrawal does not apply to the provision of accommodation services (other than residential), transport of goods, car rental, catering, or services related to leisure activities, where the contract provides for a specific date or period of performance.
Therefore, accommodation bookings at Rodnei Retreat & Spa with a specific check-in date are exempt from the right of withdrawal.

These Terms and Conditions are governed by and construed in accordance with the laws of Romania.
Any dispute arising out of or in connection with these Terms that cannot be resolved amicably shall be submitted to the competent courts at the Operator's registered office (Baia Mare, Maramureș County) or, at the consumer's choice, the competent courts at the consumer's domicile, in accordance with consumer protection legislation.
If any provision of these Terms is found to be void, invalid, or unenforceable by a competent court, that provision shall be severed from the remainder of the Terms, and all other provisions shall remain in full force and effect. The void or unenforceable provision shall be replaced with a valid provision that most closely reflects the original intent of the parties.
The Operator reserves the right to modify these Terms and Conditions at any time without prior individual notice. Changes take effect upon publication on the Website.
